Fed. Judge orders State to Clear Murder Record of Eugene Gall

LOUISVILLE, Ky. — A federal judge has ordered the State of Kentucky to expunge the record of Eugene William Gall. of Hillsboro, Ohio. Gall was once on Death Row for killing a 12-year-old Cincinnati girl.
U.S. District Judge Danny C. Reeves’s order on Thursday clears the record of 62-year-old. He was originally convicted of murder and sentenced to death in October of 1978.
Gall, who suffers from paranoid schizophrenia, was sentenced to death for kidnapping Lisa Jansen of Cincinnati as she walked to school, then raping and shooting her in Boone County.
A federal appeals court overturned Gall’s conviction in 2001, saying prosecutors failed to prove key elements of the case and that the prohibition against double jeopardy forbade a retrial. Kentucky turned Gall over to Ohio, where he is serving a life sentence for rape and murder.
Gall’s attorney, public defender Tim Arnold, says the decision may make it easier for him to argue for parole in 2021.
